This Product Disclaimer & Limitation of Liability (“Disclaimer”) applies to all products sold by Some Sun LLC (“Company,” “we,” “our,” or “us”), including but not limited to garments marketed with ultraviolet protection factor (“UPF”) properties.

By purchasing or using our products, you agree to the terms below.

1. Not a Medical Product

Some Sun products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease, including but not limited to skin cancer or other conditions related to ultraviolet (“UV”) exposure.

Our products are designed as apparel offering sun-protective properties, not as a substitute for medical advice, diagnosis, or treatment. You should consult a qualified healthcare provider regarding any medical concerns.

2. UPF Ratings and Performance

UPF ratings referenced by Some Sun are based on standardized textile testing methods, including but not limited to those developed by ASTM International and the American Association of Textile Chemists and Colorists.

However, actual performance may vary depending on real-world conditions, including but not limited to:

Fabric wear, stretching, or damage
Moisture (e.g., sweat, water exposure)
Fit and coverage of the garment
Frequency of laundering and care methods
Environmental conditions and UV intensity

Accordingly, UPF ratings are not guaranteed under all conditions, and Some Sun does not warrant that any product will provide complete or continuous protection from UV exposure.

3. No Guarantee of Protection

While our products are designed to reduce UV exposure, no garment can block 100% of ultraviolet radiation or eliminate the risk of sunburn, skin damage, or skin cancer.

Users should employ additional sun protection measures, including but not limited to:

Sunscreen on exposed skin
Hats and sunglasses
Seeking shade and limiting sun exposure

4. Proper Use

Products must be worn and cared for in accordance with provided instructions. Improper use, alteration, or misuse of products may reduce effectiveness and void any applicable warranties.

5. Limitation of Liability

To the fullest extent permitted by law:

Some Sun LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use or inability to use its products.
This includes, without limitation, damages related to sun exposure, skin conditions, or health outcomes.

In all cases, the Company’s total liability shall be limited to the purchase price of the product giving rise to the claim.

6. Assumption of Risk

By using our products, you acknowledge that exposure to sunlight carries inherent risks, and you assume full responsibility for your personal use and sun protection practices.
